By accessing or using DermaLens AI ("the Service", "we", "us", "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.

We reserve the right to update these terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised terms.

2. Description of service

DermaLens AI is an AI-powered skincare analysis tool that:

• Analyses your responses to a skin quiz and generates a personalised skin score and report
• Provides AM and PM skincare product routine recommendations tailored to your answers
• Optionally analyses a selfie photo to supplement quiz-based analysis (Pro feature)
• Allows you to track your skin score history over time (registered users)
• Recommends products available to purchase via Amazon (affiliate links)

The Service is provided for informational and cosmetic guidance purposes only.

3. Not medical advice

Specifically:

• The Service does not diagnose any skin condition, disease, or disorder
• The Service does not provide treatment recommendations for medical conditions
• AI-generated skin scores and findings are estimates based on self-reported information and/or visual observation — they are not clinical assessments
• Product recommendations are general suggestions, not prescriptions
• Results may vary and are not guaranteed to be accurate, complete, or suitable for your individual circumstances

If you have a skin condition, medical concern, persistent symptoms, or are pregnant, nursing, or under medical care, consult a qualified dermatologist or healthcare professional before following any recommendations from this Service.

4. AI-generated content disclaimer

Skin analysis reports, scores, findings, and routine recommendations are generated by an AI language model (Anthropic Claude). By using the Service you acknowledge that:

• AI-generated content may contain errors, inaccuracies, or omissions
• Results are probabilistic estimates, not definitive assessments
• The same inputs may produce different outputs on different occasions
• AI analysis of photos is not equivalent to examination by a dermatologist
• You rely on AI-generated recommendations at your own risk

5. Eligibility

You must be at least 18 years old to use DermaLens AI. By using the Service, you confirm that you meet this requirement.

6. User accounts

To access certain features (scan history, dashboard, Pro subscription), you must create an account. You agree to:

• Provide accurate and truthful registration information
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorised use of your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these terms.

7. Pro subscription and payments

Pro subscriptions are billed monthly at the price shown at checkout (£3.99/mo for UK users, $4.99/mo for US users, or local equivalent). By subscribing you agree that:

• Your subscription renews automatically each month until cancelled
• You may cancel at any time via your dashboard — access continues until the end of the billing period
• No refunds are provided for partial months, except where required by applicable consumer law
• We reserve the right to change pricing with 30 days' notice
• Payment is processed by Stripe — we do not store your payment details

UK consumers have statutory rights under the Consumer Contracts Regulations 2013, including a 14-day cooling-off period for digital services. Where a digital service has been fully performed with your explicit consent before the 14 days expire, this right may not apply.

8. Affiliate links and product recommendations

DermaLens AI participates in the Amazon Associates Programme and other affiliate programmes. This means:

• Product links in your routine recommendations may be affiliate links
• We may earn a commission if you click a link and make a qualifying purchase — at no additional cost to you
• Product recommendations are generated by our AI based on your skin profile, not on commercial arrangements with brands
• We do not endorse any specific product and make no guarantees about product suitability or results
• Purchases made through affiliate links are subject to Amazon's (or the relevant retailer's) terms and conditions
• Prices shown are approximate and may differ from the actual price at the time of purchase

9. Photo uploads

If you choose to upload a photo for the face scan feature (Pro):

• You must only upload photos of yourself — do not upload photos of other people without their explicit consent
• Photos are processed by AI for skin analysis only and are not stored after analysis
• You retain all rights to your photos
• You must not upload photos that contain illegal content, nudity, or content that infringes third-party rights
• We reserve the right to refuse or remove any content that violates these terms

10. Limitation of liability

To the maximum extent permitted by applicable law:

• DermaLens AI and its operators shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service
• We are not liable for any adverse reactions to products recommended by our AI — always patch test new skincare products and consult a professional if in doubt
• We are not liable for the accuracy, completeness, or suitability of AI-generated analysis
• We are not liable for the quality, safety, or availability of third-party products linked via Amazon
• Our total liability to you in any circumstances shall not exceed the amount you paid for the Service in the 12 months preceding the claim

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

11. Intellectual property

All content on DermaLens AI — including the website design, AI prompts, scoring methodology, and written content — is owned by or licensed to DermaLens AI. You may not copy, reproduce, or redistribute any part of the Service without our written permission.

Your personal scan data and analysis results belong to you. You may export or delete your data at any time.

12. Prohibited use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or extract data from the Service
• Upload malicious content or attempt to interfere with the Service's operation
• Create multiple accounts to circumvent usage limits
• Use the Service to make medical diagnoses or clinical assessments
• Resell or redistribute AI-generated analysis reports as professional medical or dermatological advice

13. Termination

You may close your account at any time by contacting us at support@dermalensai.com. We may suspend or terminate your access if you violate these terms, with or without notice.

14. Governing law

These terms are governed by the laws of England and Wales for users based in the United Kingdom, and by the laws of the State of Delaware (USA) for users based in the United States, without regard to conflict of law principles. If you are a consumer, you may also have rights under your local consumer protection laws which cannot be excluded.
